Terms and Conditions

Last updated: 11/3/2026

These Terms and Conditions govern your purchase and use of email marketing campaign services provided by Maxi Home Buyers LLC (“Company,” “we,” “us,” or “our”). By purchasing a campaign, submitting onboarding information, or authorizing us to begin work, you agree to these Terms.

1. Service Overview

Maxi Home Buyers LLC provides done-for-you email outreach campaigns for real estate investors and other approved business clients.

Our services may include:

  • Campaign strategy and list criteria review.
  • Data sourcing or list preparation.
  • Email verification and cleaning.
  • Domain and inbox setup or management.
  • Campaign setup and sending.
  • Reply monitoring.
  • Interested reply classification.
  • Lead delivery.
  • Basic campaign reporting.

Unless specifically agreed in writing, our service does not include seller phone calls, text messaging, appointment setting, offer negotiation, contract preparation, acquisition management, sales follow-up, legal advice, or guaranteed transaction results.

2. Campaign-Based Pricing

Our services are sold based on campaign volume, such as the number of emails sent or the size of the campaign package purchased.

We do not charge on a pay-per-lead basis. Any expected lead, reply, or interested response estimates are provided for planning and comparison purposes only.

For example, a campaign may be described as expected to produce 15 to 30 interested replies per 10,000 emails sent. The first 15 Interested Replies are guaranteed under Section 3; anything above 15 is an estimate, not a guarantee.

Actual results may vary based on list quality, market selection, property type, owner data accuracy, deliverability, offer appeal, message timing, competition, client reputation, and the client’s follow-up process.

3. Lead Guarantee and Results

Guaranteed minimum. Each campaign includes 10,000 emails sent to owners in your target market. We guarantee that each campaign will deliver at least 15 Interested Replies, as defined in Section 4.

Keep-sending remedy. If the 10,000 emails produce fewer than 15 Interested Replies, we will continue sending additional emails in your campaign, beyond the 10,000 and at no additional cost to you, until 15 Interested Replies have been delivered. Continued sending is our sole obligation and your sole remedy if the guaranteed minimum is not reached.

Estimates above the minimum. Any number above 15 Interested Replies, including the 15 to 30 Interested Replies per 10,000 emails we describe as typical, is an estimate based on past campaigns and is not guaranteed.

No refunds. The guarantee is fulfilled by continued sending, not by a refund. Campaign fees are not refundable based on reply volume, lead quality, or results.

What we do not guarantee. Other than the 15 Interested Reply minimum, we do not guarantee:

  • A specific number of replies.
  • A specific number of Interested Replies.
  • A specific reply rate.
  • A specific delivery rate or inbox placement rate.
  • Seller appointments.
  • Signed contracts.
  • Closed deals.
  • Revenue, profit, return on investment, or acquisition outcomes.

You are responsible for reviewing and following up with the replies and leads we deliver. Your follow-up speed, sales process, offer strategy, and ability to convert opportunities may significantly affect your results.

4. Interested Reply Definition

An “Interested Reply” means a seller or recipient response where the recipient does not clearly say no and raises their hand in some fashion.

Interested Replies may include, but are not limited to, replies where the recipient:

  • Says yes.
  • Asks for an offer.
  • Provides any price number, regardless of amount.
  • Says they would consider selling.
  • Says they may sell for the right price.
  • Asks how the process works.
  • Requests a phone call.
  • Provides a phone number.
  • Mentions timing, condition, tenants, listing status, decision makers, or another property.
  • Otherwise engages with the campaign without clearly declining.

We classify replies based on the literal text of the response. We do not assume sarcasm, hidden meaning, tone, or intent beyond what is written.

Replies that clearly say no, request removal, say unsubscribe, state that the recipient is the wrong person, indicate that the recipient does not own the property, or are bounce messages or automatic replies are not classified as Interested Replies.

5. Client Responsibilities

You agree to provide accurate, complete, and timely information needed to set up and run your campaign.

This may include:

  • Your legal business name.
  • Your approved sender name.
  • Your mailing address.
  • Your business phone number.
  • Your website, if applicable.
  • Target market criteria.
  • Property type or audience criteria.
  • Any prior suppression or opt-out lists.
  • Any required disclaimers or licensing information.
  • Approval of campaign copy.
  • Accurate information about your business, offer, and services.

You are responsible for making sure the information you provide is truthful, current, and not misleading.

You are also responsible for promptly following up with leads, replies, and opportunities delivered to you.

6. Campaign Approval

Before a campaign is launched, you may be asked to review and approve the campaign copy, sending identity, target criteria, and related campaign details.

Your approval confirms that:

  • The sender identity is accurate.
  • The business information is accurate.
  • The offer is truthful.
  • The mailing address is valid.
  • The copy does not contain false or misleading claims.
  • You authorize us to send the campaign on your behalf.

We reserve the right to revise, reject, pause, or cancel any campaign that we believe may be misleading, non-compliant, high-risk, harmful to deliverability, or inconsistent with our service standards. Whether the 15 Interested Reply guarantee in Section 3 continues or is void after any of these actions is governed by Section 24.

7. Email Compliance

All campaigns are intended to be operated in accordance with applicable commercial email rules, including the CAN-SPAM Act.

The FTC’s CAN-SPAM guidance states that commercial email must not use false or misleading header information, must not use deceptive subject lines, must identify the message as an advertisement when required, must include a valid physical postal address, must provide a clear opt-out method, and must honor opt-out requests promptly. The FTC also states that companies remain responsible for email marketing performed on their behalf by vendors.

You agree to cooperate with all reasonable compliance requirements we apply to your campaign.

This includes providing:

  • A valid physical mailing address.
  • Accurate sender information.
  • Non-deceptive campaign content.
  • Any prior opt-out or suppression information.
  • Any industry-specific disclaimers required for your business.

You agree that we may include opt-out language, business identification language, mailing address information, or other compliance language in campaign emails.

8. Opt-Outs and Suppression

Recipients must be able to opt out of future emails.

If a recipient requests removal, unsubscribes, says “stop,” says “remove me,” or otherwise communicates that they do not want future emails, that recipient will be treated as an opt-out.

Opt-outs may be added to a client-specific suppression list, global suppression list, or both.

You agree not to ask us to email any person who has opted out of receiving future emails from you, your campaign, or our sending operation.

You are responsible for providing us with any prior opt-out, unsubscribe, do-not-contact, or suppression lists before a campaign is launched.

9. Prohibited Campaigns and Content

We do not accept every industry, offer, or campaign type.

We may reject campaigns involving:

  • False or misleading claims.
  • Fake urgency.
  • Fake prior relationships.
  • Deceptive subject lines.
  • Misleading government, legal, insurance, tax, or official notice language.
  • Sensitive personal targeting.
  • Healthcare, medical, or mental health offers.
  • Credit repair, debt relief, loans, or financial offers.
  • Insurance, Medicare, or benefits-related offers.
  • Legal services or attorney advertising.
  • Cannabis, CBD, THC, tobacco, vaping, alcohol, gambling, adult products, firearms, or other regulated products.
  • Any campaign that may create excessive spam complaints or deliverability risk.
  • Any campaign we determine, in our sole discretion, is not a fit for our service.

We may also reject any campaign that targets vulnerable people or appears to exploit financial distress, health conditions, legal problems, age, disability, foreclosure status, or other sensitive personal circumstances.

10. Copywriting Standards

Campaign copy must be truthful, plain-language, and not misleading.

You agree that campaign copy may not:

  • Claim or imply a prior conversation if one did not occur.
  • Use “Re:” or “Fwd:” in a deceptive way.
  • Imply the sender is a government agency, lender, title company, utility, attorney, court, insurance company, or official department unless that is true.
  • Use false deadlines or fake urgency.
  • Misrepresent the reason for contacting the recipient.
  • Misrepresent the sender’s identity.
  • Make guarantees that are not true.
  • Make claims that cannot be substantiated.
  • Hide the commercial or business purpose of the message.

We may edit or require changes to campaign copy before launch.

11. Data and List Quality

Campaign performance depends heavily on the quality and accuracy of data.

You understand that property records, owner information, email addresses, and skip-traced data may be incomplete, outdated, inaccurate, or associated with the wrong person.

We do not guarantee that every email address, owner name, property record, or contact record is accurate.

We may use third-party platforms, data providers, verification tools, email platforms, CRM tools, and other software to prepare and send campaigns.

12. Deliverability

We use reasonable efforts to support deliverability, which may include email verification, domain configuration, inbox management, authentication records, sending limits, and reply monitoring.

However, email deliverability is affected by factors outside our control, including mailbox provider filtering, spam complaints, recipient behavior, sender reputation, domain reputation, platform rules, message content, list quality, and market conditions.

We do not guarantee inbox placement, delivery to every recipient, or avoidance of spam folders.

We may pause, slow down, revise, or stop a campaign if we believe continued sending may create deliverability, compliance, or reputation risk.

If we pause a campaign, the 15 Interested Reply guarantee in Section 3 still applies and sending will resume until it is met, unless the pause results from your conduct as described in Section 24. However, if a third-party platform or service we depend on, such as an email sending provider, inbox or domain provider, or data provider, suspends, discontinues, or materially restricts its service in circumstances outside our reasonable control (see Section 17), the guarantee is suspended for that period or may not be able to be fulfilled, and this does not create any refund obligation.

13. Client Follow-Up

Our service delivers replies and potential opportunities. You are responsible for all follow-up after a lead or reply is delivered.

This includes:

  • Calling the recipient.
  • Texting the recipient, if lawful and appropriate.
  • Qualifying the opportunity.
  • Making offers.
  • Negotiating terms.
  • Preparing contracts.
  • Complying with laws related to calls, texts, sales, licensing, real estate transactions, and consumer protection.
  • Managing your CRM and follow-up process.

We are not responsible for your follow-up practices or sales outcomes.

14. Payment Terms

Payment is due before campaign work begins unless otherwise agreed in writing.

Campaign fees are earned based on campaign preparation, setup, data work, sending infrastructure, management, and execution, not based on the number of leads or deals generated.

Unless otherwise stated in writing, payments are non-refundable once campaign setup or data preparation has begun.

If a campaign is delayed because you fail to provide required information, approvals, or access, you remain responsible for the campaign fee.

15. Refunds and Make-Goods

Other than the keep-sending guarantee in Section 3, we generally do not provide refunds or other remedies based on reply volume, lead quality, deal conversion, or client follow-up outcomes.

At our sole discretion, we may offer a make-good, partial resend, campaign credit, or other adjustment if we determine there was a material execution error on our part.

Examples of issues that generally do not qualify for a refund include:

  • Low reply volume.
  • Low interested reply volume.
  • Poor market selection.
  • Poor list quality from available data sources.
  • High competition in the target market.
  • Recipient complaints.
  • Client dissatisfaction with seller asking prices.
  • Client failure to follow up quickly.
  • Client inability to convert replies into appointments, offers, contracts, or deals.

16. Campaign Timing

Estimated launch dates and completion timelines are not guaranteed unless specifically stated in writing.

Campaign timing may depend on:

  • Client onboarding completion.
  • Data availability.
  • Email verification.
  • Domain and inbox setup.
  • Platform limits.
  • Sending limits.
  • Deliverability controls.
  • Compliance review.
  • Client approval delays.

We may adjust campaign timing to protect deliverability, comply with platform rules, or reduce campaign risk.

17. Platform and Third-Party Tools

We may use third-party software, data tools, email platforms, verification providers, hosting providers, CRMs, automation tools, and other vendors to provide the service.

We are not responsible for outages, pricing changes, policy changes, data limitations, deliverability changes, or errors caused by third-party platforms.

If a third-party platform change materially affects the campaign, we may modify the campaign process, timeline, or available services.

18. Intellectual Property

We retain ownership of our internal systems, workflows, templates, processes, software, automations, campaign structures, documentation, and proprietary methods.

You retain ownership of your business name, brand assets, client-provided materials, and approved client-specific campaign information.

You may not copy, resell, license, distribute, or reverse engineer our systems, workflows, templates, or processes without written permission.

19. Confidentiality

Both parties agree to use reasonable care to protect confidential business information shared during the service relationship.

Confidential information may include campaign strategy, pricing, lead data, client information, business processes, login information, and non-public performance data.

This does not include information that is publicly available, independently developed, already known, or required to be disclosed by law.

20. Data Handling

You authorize us to use campaign data, contact records, property information, email addresses, reply data, and related information as needed to provide the service.

We will use reasonable efforts to protect client data and campaign information.

You are responsible for ensuring that you have the right to provide any data, suppression lists, customer lists, or business information you give us.

We may retain campaign records, suppression records, reporting data, and reply classification data for operational, compliance, quality control, and recordkeeping purposes.

21. Case Studies and Performance Data

Unless you opt out in writing, we may use anonymized or aggregated campaign performance data for internal analysis, marketing, benchmarking, and case studies.

We will not publicly disclose your confidential business information, seller names, full lead details, private campaign data, or identifiable client performance results without your permission.

22. Limitation of Liability

To the maximum extent permitted by law, our liability for any claim related to the services is limited to the amount you paid for the specific campaign giving rise to the claim.

We are not liable for lost profits, lost deals, lost revenue, business interruption, reputational harm, platform issues, deliverability problems, data inaccuracies, legal claims arising from client-provided information, or indirect, incidental, special, consequential, or punitive damages.

23. Indemnification

You agree to defend, indemnify, and hold harmless Maxi Home Buyers LLC, its owners, employees, contractors, and service providers from claims, damages, penalties, losses, costs, and expenses arising from:

  • False, inaccurate, or misleading information you provide.
  • Your products, services, offers, or business practices.
  • Your follow-up communications with recipients.
  • Your failure to provide suppression or opt-out information.
  • Your violation of applicable laws.
  • Campaign content or claims you approve.
  • Your misuse of leads, replies, or campaign data.

24. Termination

We may refuse, pause, or terminate services at any time in any of the following cases, as reasonably determined by us:

  • A campaign may violate applicable law.
  • A campaign may create excessive complaints.
  • A campaign creates deliverability or reputation risk.
  • You provide false or misleading information.
  • You fail to provide required onboarding information.
  • You fail to pay amounts due.
  • You request that we send misleading, deceptive, or prohibited content.
  • You act in bad faith or misuse leads, replies, or campaign data.
  • We decide to stop offering services to you, subject to the guarantee terms below.

If services are terminated after campaign work has begun, fees already paid may be non-refundable.

If we pause or end services for reasons not caused by you, such as deliverability, compliance, or risk concerns on our side or our own decision to stop providing services, the 15 Interested Reply guarantee in Section 3 still applies. If we pause a campaign, sending will resume until the guarantee is met. If we end services, we will continue sending for any campaign already paid for until 15 Interested Replies have been delivered before services end. If a third-party platform outage or restriction outside our reasonable control, as described in Sections 12 and 17, prevents fulfillment, the guarantee is suspended for that period or may not be able to be fulfilled, and no refund is owed. If we pause, cancel, reject, or terminate services because of your conduct, including providing false or misleading information, failing to provide required onboarding information, failing to pay amounts due, requesting misleading, deceptive, or prohibited content, acting in bad faith, or misusing leads, replies, or campaign data, the guarantee in Section 3 is void and no refund is owed.

25. No Legal, Financial, or Real Estate Advice

Our services are marketing and campaign management services only.

We do not provide legal advice, financial advice, tax advice, real estate brokerage services, valuation advice, investment advice, or compliance opinions.

You should consult your own attorney, accountant, broker, compliance advisor, or other professional as needed.

26. Changes to These Terms

We may update these Terms from time to time.

The version in effect at the time of purchase or campaign authorization will apply to that campaign unless otherwise agreed in writing.

27. Acceptance

By purchasing a campaign, submitting onboarding information, approving campaign copy, or authorizing us to begin work, you confirm that you have read, understood, and agreed to these Terms and Conditions.
